Sharia Court Grants Woman, 23, Divorce Over Husband's Inability To Provide Food





Kaduna – A Kaduna Sharia Court on Tuesday granted divorce to a 23-year-old mother of one,  Maijidda Waziri, over the failure of the husband to provide food to the family.
Waziri brought the case on  Oct. 17, urging the Sharia Court two at Magajin Gari to dissolve the marriage.



She told the court that her husband, Mohammed Sani had failed in his obligation to feed the family, and that she had to rely on her parents for food.

The case was adjourned three times during which the complainant presented three witnesses, including her father in-law.

In his ruling, the presiding officer, Malam Ibrahim Inuwa said the complainant had proved her case beyond reasonable doubt and granted her request by dissolving the marriage.

‘“From today, Nov.13, 2012 the court has granted divorce to Maijidda Waziri and she is no longer the wife to Mohammed Sani.”

Inuwa said Sani had violated a major condition of marriage in Islam, which provided that a person can only marry if he is capable of providing feeding, clothing and shelter to the wife.

“The Prophet said if a man is not capable of meeting these conditions he should fast. Lack of feeding is against the Sharia provisions on marriage.’’ (NAN)
